Terms of Service

01 Agreement

These terms govern every service UAB LitLink (LitLink) provides under a signed service order. The service order, this document, the Acceptable Use Policy and the Service Level Agreement together form the agreement. Where they conflict, the service order prevails.

02 Services and orders

LitLink delivers the services described in the service order, including IP transit, dedicated internet access, DDoS mitigation and colocation. Target delivery dates are estimates. The service term starts on the date LitLink confirms the service is ready for use.

Changes to port size, commit or location require a new service order or a written change request accepted by both parties.

03 Term and termination

The initial term is stated in the service order and renews for successive twelve month periods unless either party gives ninety days written notice before the end of the current term.

Either party may terminate for material breach not cured within thirty days of written notice. LitLink may suspend service immediately where continued operation threatens the network or breaches the Acceptable Use Policy.

04 Fees and billing

Recurring fees are invoiced monthly in advance. Burst usage on transit ports is measured at the 95th percentile of five minute samples over the billing month and invoiced in arrears. Invoices are due within thirty days.

Overdue amounts accrue interest at the statutory rate. LitLink may suspend service after fifteen days written notice of non payment.

05 Service levels

Availability, latency, packet loss and jitter commitments and the associated credits are set out in the Service Level Agreement. Service credits are the sole remedy for failure to meet those commitments.

06 Customer responsibilities

The customer is responsible for its own equipment, for maintaining accurate technical and abuse contacts and for all traffic sent through the service, including traffic from its own customers.

The customer must announce only prefixes it is authorised to announce, keep RPKI ROAs current and respond to abuse reports within the timeframes in the Acceptable Use Policy.

07 IP addresses and BGP

Address space assigned by LitLink remains LitLink property and must be returned on termination. Customer announced prefixes are filtered against IRR and RPKI data. LitLink may reject or filter announcements that are invalid, unauthorised or that threaten routing stability.

08 Liability

Neither party is liable for indirect or consequential loss, loss of profit or loss of data. LitLink total liability in any twelve month period is limited to the fees paid for the affected service in that period. Nothing limits liability for death, personal injury, fraud or where limitation is prohibited by law.

09 Governing law

This agreement is governed by the laws of the Republic of Lithuania. Disputes are subject to the exclusive jurisdiction of the courts of Vilnius, without prejudice to mandatory consumer or regulatory rules in the country of service delivery.
